The property regimes of civil partners and the jurisprudential recognition of the property relations of non-marital de facto partners

Abstract

This paper analyses the property regime for civil partners established in the Civil Union Agreement Law (LAUC), examining the question of whether it effectively responds to the needs of these partners. Likewise, the jurisprudential regime created before the LAUC to solve the patrimonial problems of non-marital de facto unions is studied, a regime that has continued to be applied to de facto partners that are not linked by a Civil Union Agreement. Following the hypothesis of the obsolescence of the LAUC, it is concluded that, unlike the LAUC, the jurisprudential regime is more suitable for managing the property relations of cohabitants.
