Abstract

This paper presents the opinion E529150 of the Office of the Comptroller General of the Republic, which questions the legality of a series of circulars and resolutions issued by the Director General of Water by virtue of the regulatory power attributed under Article 300 of the Water Code. An analysis is then made of the legitimate scope of the exercise of this power from the dogmatic point of view, explaining the mechanisms of authorization and its legitimate development. It ends with the necessary conclusions.
