Abstract
Through a structural reconstruction of the majority-rule and the qualified majority-rule, this work provides a binary justification of the majority-rule, which enables the enunciation of the form to which an argument in favor of the qualified majority-rule should respond. As a conclusion it is argued against the reasons that have been adduced to apply the qualified majority-rule to the parliamentary law-making and constitutional amendment process.
