Abstract

This paper analyses the atypical torts theory and the legal disposition theory that has been formulated by Atienza and Ruiz Manero in 'Ilicitos Atipicos' and 'Las Piezas del Derecho'. Specifically, it is studied how the atypical torts theory darkens their legal disposition theory. The thesis that holds is that the atypical torts theory is a theory of legal interpretation related to the construction of implicit exceptions. It is concluded that the authors should make explicit their theory of legal interpretation.
